1. Agreement
These Terms of Use ("Terms") apply when you download, install, try, buy or use the Line by Air app, its online features and this website (together, "Line by Air" or "the service").
By using Line by Air, you agree to these Terms. If you use it on behalf of a business, you agree for that business, and you confirm you have authority to do so. If you don't agree, don't use the service.
Our Privacy Policy and Refund Policy are part of these Terms.
2. Who we are
Line by Air is a trade name of Three Sixty Images LLC, 72-4897 Hoomalie Place, Kailua-Kona, HI 96740 ("we", "us"). You can reach us at [email protected].
Purchases are handled by Paddle.com, our reseller and merchant of record. See Plans and billing.
3. Not a survey — accuracy and no reliance
Line by Air is not a survey. It draws approximate property-line overlays for visualization only.
Overlays, distances, areas and elevations are derived from publicly available parcel data, drone telemetry (GPS, altitude and gimbal orientation) and digital elevation models. Each of these has its own margin of error. Lines can be off by a noticeable amount, and parcel records can be out of date.
Do not rely on Line by Air output for:
- boundary determinations or boundary disputes;
- legal proceedings, deeds or title work;
- construction layout, setbacks, easements or rights-of-way;
- fence placement, landscaping or siting a structure;
- zoning, code compliance or permits; or
- any other decision where accurate property lines matter.
For any of these, consult a licensed land surveyor. You use the output at your own risk, and you are responsible for how you and anyone you share it with use it.
4. Your licence to use Line by Air
Line by Air is licensed, not sold. Subject to these Terms and your plan, we give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on the number of Macs your plan allows.
You may not sell, resell, rent, lease, sublicense or redistribute the software or your licence key. Developer use, bulk use or integration into another product needs a separate written agreement with us.
Your content stays yours. You own your photos, videos, project files and the images and videos you export. We claim no rights in them. They stay on your Mac. See our Privacy Policy.
5. Free trial
You can try Line by Air without paying. The trial:
- needs no payment details;
- adds a watermark to exports;
- ends after 14 days or 3 properties, whichever comes first; and
- is limited to one trial per Mac.
Don't try to reset, extend or work around the trial. Trial exports must keep their watermark.
6. Plans and billing
Paddle is the merchant of record
Our order process is run by Paddle.com, which is the reseller and merchant of record for all orders. Paddle takes payment, charges any sales tax or VAT, issues invoices and handles billing questions and refunds. Paddle's own terms and privacy policy apply to checkout.
Plans
- Pay as you go — $9 per property credit, up to 5 per order. A "property" is one Line by Air project. One credit lets you export that project; re-exporting the same project is free for 30 days after its credit is used. Credits don't expire unless we tell you otherwise at purchase.
- Pro — $39 per month or $390 per year. Unlimited properties on up to 2 Macs.
- Studio — $99 per month or $990 per year. Unlimited properties on up to 6 Macs.
- Developer — custom annual agreements. Their terms are set in a separate written agreement, which takes priority over these Terms where they conflict.
Prices are in US dollars and exclude any tax Paddle charges. "Unlimited" is subject to the fair-use limits in section 13.
Renewals and cancellation
Subscriptions renew automatically at the end of each monthly or annual period, at the then-current price, until you cancel. You can cancel anytime. Cancellation takes effect at the end of the period you've paid for, and you keep access until then.
Refunds are covered by our Refund Policy.
Price changes
We may change prices. For existing subscriptions, we'll give you at least 30 days' notice by email before a new price applies to your next renewal. If you don't want to pay the new price, cancel before the renewal.
7. Licence keys and Macs
Paid plans come with a licence key (in the form LBA-XXXXX-XXXXX-XXXXX-XXXXX). You activate the key on each Mac you use. You can deactivate a Mac at any time to free up a slot for another.
Keep your key private. Don't share it with anyone outside your plan's Mac limit. We may deactivate or revoke keys that are shared, leaked or used beyond their limit.
The app checks your licence online when you export. Paid subscriptions keep working offline for up to 7 days; after that, the app needs to reconnect before you can export again.
8. Acceptable use
You agree not to:
- reverse engineer, decompile or disassemble the app, except where the law expressly allows it;
- bypass, disable or interfere with licence checks, activation limits, the trial or the watermark;
- scrape, harvest, bulk download or systematically extract parcel data or other data through Line by Air, or use it to build a competing dataset or product;
- overload, probe or attack our servers or the services we connect to;
- use Line by Air to harass anyone, or to misrepresent where a property boundary lies — for example, presenting an overlay as a survey or as proof of a boundary;
- remove or obscure the visualization disclaimer, map attributions or other notices where these Terms require them; or
- use the service in breach of any law.
Flying is your responsibility. You are responsible for how your photos are captured. That includes following drone rules (in the US, for example, FAA Part 107 for commercial flights), airspace restrictions, and privacy, trespass and image laws where you fly and where you share your work.
9. Third-party data and services
Line by Air relies on data and services from other organizations, including:
- state and county GIS services, such as the Hawaii Statewide GIS Program and the Montana State Library / Department of Revenue;
- ReportAll USA, for commercial nationwide parcel data, accessed through our server;
- Esri, for satellite basemap imagery and address search;
- the USGS Elevation Point Query Service, for ground elevation; and
- DJI, when you import a flight log that needs unlocking.
Parcel records are not authoritative and can be months out of date. Third-party data is provided by its owners under their own terms, which may apply to you. We don't control it and make no warranty about it. Keep the source credits shown in the app.
10. Exports and sharing
You may use your exports for your own and your clients' purposes, including marketing a property, subject to these Terms.
When you share exports with anyone else — and always when you use them commercially — you must keep a visible visualization disclaimer with them, stating that the lines are approximate and not a survey. The app can add one to exports for you. You must also keep any required map and data attributions.
11. Intellectual property
We (and our licensors) own Line by Air, including the software, its design, the Line by Air name and logo, and this website. These Terms don't give you any rights in them beyond the licence in section 4.
Line by Air is patent pending (US provisional application filed).
12. Feedback
We welcome ideas and bug reports. If you send us feedback, you allow us to use it to improve Line by Air without owing you anything. We won't publish your name with it without asking.
13. Availability and changes to the service
Online features — parcel lookups, address search, elevation, flight-log unlocking, licensing and update checks — depend on our servers and on third parties. Providers can change, limit or stop their services, and coverage can change, sometimes without notice to us. We'll try to keep things running, but we don't promise any particular coverage or uptime.
Parcel lookups are subject to fair-use limits, including daily caps, to keep the service working for everyone. We may adjust these limits.
We may update, change or remove features. If we remove a core feature you've paid for during a subscription period, contact us and we'll work out a fair remedy, such as a pro-rata refund.
14. Warranty disclaimer
To the fullest extent the law allows, Line by Air and all data, overlays and exports are provided "as is" and "as available", without warranties of any kind, express or implied. That includes any warranty of accuracy, merchantability, fitness for a particular purpose, title or non-infringement, and any warranty that the service will be uninterrupted or error-free.
Some places don't allow certain warranty exclusions, so some of these may not apply to you.
15. Limitation of liability
To the fullest extent the law allows:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunity; and
- we are not liable for any loss arising from reliance on overlays, distances, areas, elevations or parcel data, including any of the uses listed in section 3.
Our total liability for all claims relating to Line by Air is limited to the fees you paid for it in the 12 months before the event giving rise to the claim.
These limits apply whatever the legal theory, even if we were told the loss was possible. Nothing in these Terms limits liability that the law does not allow to be limited.
16. Indemnity
You agree to defend and indemnify Three Sixty Images LLC against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, how you capture, use or share images and exports, or any reliance by you or others on Line by Air output contrary to section 3.
17. Termination
You can stop using Line by Air at any time. To end a subscription, cancel it as described in section 6.
We may suspend or end your licence, and deactivate your key, if you materially breach these Terms — for example by sharing keys or bypassing licence checks. Where reasonable, we'll tell you first and give you a chance to fix it.
When your licence ends, you must stop using the app. Exports you made under a valid licence remain yours to use under section 10. Sections that by their nature should survive — including 3, 9, 11 and 14 to 19 — do.
18. Changes to these terms
We may update these Terms. We'll post the new version here with a new date. If a change is material, we'll give you reasonable notice, for example by email or in the app. If you keep using Line by Air after the change takes effect, you accept the new Terms.
19. Governing law
These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws rules. Disputes will be resolved in the state courts located in the County of Hawaiʻi or the federal courts for the District of Hawaii, and you and we consent to their jurisdiction.
If any part of these Terms is unenforceable, the rest still applies. If we don't enforce a term right away, we can still enforce it later. You may not transfer these Terms without our consent; we may transfer them as part of a sale or reorganization of our business.
